Introduction

Canvas & Code Ltd trading as ‘Art Hub.vip’, ‘Art Hub’ and ‘The Art Hub’ (“Company”, “We”, “Our”, “Us”), by buying / selling / advertising (“Products” and “Services”) through our platform https://newsite.art-hub.vip or its sub-domains (“Site”), you agree to be legally bound by these Terms and Conditions (“Terms”). You should immediately discontinue use if you do not agree to these Terms.

We reserve the right to take appropriate legal action against any entity, or immediately terminate existing and future use of the Site or Services for breach of these Terms.

Site and Services

The Site fundamentally provides a hosted online platform to connect artists (“Sellers”) with customers (“Buyers”) to facilitate the purchase, rental or licensing of artwork. We connect two entities (Buyer & Seller) to make a private transaction for goods, and cannot be held liable for taxation, 3rd party or civil liability, or specific consumer rights. We offer Services including (but not limited to); artist storefront pages, artwork catalogue with search functions, featured or promoted artwork, advertising, facilitating private two-way communication between Sellers and Buyers, dispute resolution (including copyright infringement DMCA takedowns, authenticity & damage-in-transit), secure payment gateways, competitive shipping, and certification of original art. Some services may be restricted to some individuals or offered as part of a paid service, but such services will be appropriately highlighted. You remain responsible for obeying relevant local or national laws and regulations.

User Accounts

Registration: Buyers are encouraged but not required to create an account to purchase art. However, account registration is required to claim discounts or concessions. Sellers must register and maintain a valid account to sell art on the Site. Registration requires information including name, email address, telephone number, and residence. Users under the age of 18 are not permitted to use the platform. Data is handled in accordance with our Privacy Policy. We reserve the right to remove, reclaim, or change an email or username if we determine that such username is inappropriate, or violates the User Obligations / Prohibited Activities.

Account Security: Users are responsible for maintaining the confidentiality of their account information and password. Users agree to notify us immediately of any unauthorised use or compromise of their account. We cannot be held liable for any loss as a result of account compromise.

Purchasing and Transactions

Payment: We accept payments via debit/credit card (Visa, MasterCard, American Express) and Cryptocurrency (Bitcoin) through secure payment gateways. Payments are made through secure portals, and may be subject to additional anti-fraud protection by the relevant financial institutions. You may collect relevant loyalty points through the card provider, and we will not charge any additional fees for use of Credit Cards. The use of ‘disposable’ or ‘one-time’ virtual bank cards is prohibited. Final payments are made in the currency of the United Kingdom (Great British Pounds GBP £), with any additional fees displayed during checkout; we will not charge any hidden fees. By placing an order, you agree to pay the sum displayed during checkout, and you authorise us to charge your chosen payment provider prior to dispatch of the Product(s) or Service(s). We reserve the right to refuse, cancel or limit any order placed for Products or Services without reason, but will refund paid funds appropriately.

Order Processing: Orders will not be fulfilled until payment is cleared. Sellers are responsible for packaging items appropriately and dispatching items in a timely manner – financial penalties may be applied to sellers who dispatch outside of the agreed time-frame. We are unable to guarantee orders are dispatched or delivered within the advertised time-frame. Orders are considered a private transaction between Buyer & Seller and we cannot be held liable for taxation, civil liability or compliance with specific consumer rights.

Shipping and Handling: We provide competitive shipping options with trusted couriers, and will act as an agent of the involved parties to resolve any shipping disputes or claims. However, we make no guarantees as to the delivery timeframes, or the condition of the product upon delivery. You will not be eligible for any compensation for delayed or cancelled deliveries. It is the artist’s responsibility to familiarise themselves with the courier’s Terms and Insurance, and to ensure packaging meets their requirements. You agree to waive us liability for any financial loss, damage, or inconvenience caused directly or indirectly by damage or loss during transit.

User Obligations 

As a User of the Site or Services, you agree to:

Provide accurate, truthful, up-to-date and complete information.

Use the Site in compliance with all applicable laws and regulations.

Respect the intellectual property rights of others; it is prohibited to distribute or profit from copyrighted material – see ‘Copyright Infringement’. 

Refrain from accessing the Site or Services for any fraudulent or illegal purpose, including to launder the proceeds of crime.

Prohibited Activities

As a User of the Site or Services, you must not participate or attempt to participate in any of the following Prohibited Activities;

Selling copyrighted material without explicit consent / commercial licence from the owner.

Misrepresenting artwork including the dimensions, style or colour(s).

Uploading content deemed to be confidential, false/misleading, extremist, terroristic or malicious. 

Interfering with the operation of the Site, or accessing the Site or Services through a bot, script, exploit or other unauthorised means. The use of VPNs is discouraged as it may be seen as malicious, fraudulent or to circumvent security measures.

Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

Trick, defraud, or mislead other users, including the sale of particular counterfeit or unoriginal / copyrighted artwork, or in an attempt to gain unauthorised access to systems, accounts or credentials.

Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.

Use any information obtained from the Services in order to harass, abuse, cyber-stalk or harm another person.

Make improper use of our support services or submit false reports of abuse or misconduct.

Use the Services in a manner inconsistent with any applicable laws or regulations.

Engage in unauthorised framing (making contents viewable from another site) or linking to the Site or Services. 

Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance thereof. 

Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

Delete the copyright, watermark, signature or other proprietary rights notice from any content.

Attempt to impersonate another user, staff member or authority. 

Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (‘gifs’), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as ‘spyware’ or ‘passive collection mechanisms’ or ‘pcms’).

Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Site or Services.

Harass, annoy, intimidate, or threaten any of our employees or staff engaged in providing any portion of the Site or Services to you.

Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Site or Services (including “hacking”).

Copy, reproduce, alter or adapt the Site or Services, including but not limited to Flash, PHP, HTML, JavaScript, or other code. This includes even temporary ‘inspection’ and even for marketing or advertisement purposes unless with our expressed permission.

Any attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site or Services.

Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorised script or other software.

Use a buying agent or purchasing agent to make purchases on the Services.

Make any unauthorised use of the Services, including collecting personally identifiable information of users / staff by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.

Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.

Chargebacks regardless of reason may result in Account Termination. Chargebacks are damaging to our financial profile and reputation and can be abused by Buyers. Please see our Refund Policy, and reach out directly to resolve any issues.

Breach of these Terms will result in Account Termination and potentially loss of funds. See ‘Account Termination’.  

Content Ownership and Use

Site Content: All content on the Site, including banners, Trademarks and logos are our property. Site content must not be redistributed, copied, or used for other commercial purposes without our express permission.

User Content: Original art uploaded by artists remains their property. However, the Site reserves unrestricted rights to reproduce, copy, and distribute such content for marketing and advertising purposes. Artists may use content generated from the Site for their own promotional use as well as share links to their storefront.

User-Submitted Content

You are responsible for the content you upload to the site, including images, video, text, posts or comments. Content found to be in contravention of your User Obligations will be removed and your account may be terminated. You warrant that content is original to you, or that you have the relevant licences, commercial rights and/or permissions to submit such content. The use of software or bots alongside your submissions or content, other than existing, authorised Site features is not permitted. 

You are solely responsible for your Submissions and/or Contributions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) these terms, (b) any third party’s intellectual property rights, or (c) applicable law.

Copyright Infringement

We respect the intellectual property rights of others. If you (“plaintiff”) believe that any material available on our Site or accessed through the Services infringes upon any copyright you own or control, please immediately notify us via email. A Copyright notice will be served on the user (“defendant”) to immediately take down the content and a review will take place. You will be required to supply relevant evidence as to the basis of your claim, and you will be held liable for any false representations or malicious claims. Seeking specialist legal advice is always advisable.

Products & Services

We encourage products to be photographed in good lighting, captured with a good quality camera and with accurate accompanying details such as dimensions, materials or edition. We encourage the use of Augmented Reality (AR) technology that we provide to test-fit art in your room prior to purchase. We care about the satisfaction of Buyers, and offer a 60 Day Money Back Guarantee (subject to terms) for peace of mind. We also make every effort to display clear pricing and specifications for our Services.

However, we cannot guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue or remove-from-sale any product at any time without reason, and prices for all products are subject to change. We do not currently offer any kind of ‘price match guarantee’ on our Products or Services.

Subscriptions

Billing and Renewal

Your subscription will continue and automatically renew unless cancelled. You consent to us charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. The length of your billing cycle will depend on the type of subscription plan you choose when you subscribed to the Services. Forgot to cancel? We offer a 3-Day Money Back Guarantee (subject to terms), for any auto-renew automatic subscription charge.

Cancellation

You can cancel your subscription at any time by contacting us by email, or through your Account. Your cancellation will take effect at the end of the current paid term.

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to your existing or future subscription term.

Return / Refund Policy

Introduction

Canvas & Code Ltd trading as ‘Art Hub.vip’, ‘Art Hub’ and ‘The Art Hub’ (“Company”, “We”, “Our”, “Us”), strive to ensure our customers are satisfied and feel comfortable using our platform.

By buying / selling / advertising / accessing (“Products” and “Services”) through our platform https://newsite.art-hub.vip or its sub-domains (“Site”), you agree to be legally bound by this Return / Refund Policy (“Refund Policy”).

General Conditions

Eligibility: Refunds are only available for Products and Services purchased through our Site. To be eligible for a refund, the request must be made within the relevant timeframe:

Products – Within 60 days of the order date

Services – Within 3 days of the order date

Subscriptions – Within 3 days of the order date

Condition: Products must be returned in the same condition as they were received, without any damage or alteration. Claims for damage during transit are handled differently, see ‘Purchasing and Transactions’. Services or Subscriptions are eligible for a refund in any condition (within the scope of our T&Cs). 

Refund Process

Requesting a Refund: To request a refund, please use your online account or contact our customer support at info@newsite.art-hub.vip with your order details, reason for the refund, and any supporting evidence (e.g., photographs). The request must be made within the published eligible time frame to qualify. 

Approval: Once your refund request is received, it will be reviewed and you will be notified out the outcome, typically within 5 business days.

Return Shipping: If your refund is approved, we will provide an appropriate prepaid shipping option by a trusted courier, but you will be responsible for ensuring the item is packaged securely in line with the courier’s Terms. We always recommend taking photos prior to dispatching to the courier to support shipping damage or loss claims.

Refund Amount: After successful return of the product(s), you will receive a full refund, less the cost of prepaid postage. If the returned item is damaged or lost in transit and the loss cannot be recouped from the courier, we cannot be held liable for any financial loss or inconvenience, and will not reimburse any payments.  

Refunds for Damaged or Defective Items

Reporting Damage: If you receive a damaged or defective item, please notify us immediately via email with details and photographs of the damage. Claims for Damage, Loss or Missing Contents during transit must be made in line with the courier’s Terms & Conditions, typically within 30 days of dispatch. 

Supporting Claims: You should keep all packaging for inspection until the claim is resolved. You may be asked to complete a questionnaire or supply supporting information including photographs. In order to be eligible for a refund for shipping claims, you will be required to support the claims process in line with the courier’s request(s).  

Non-Refundable Items

Custom or personalised orders are not eligible for refunds unless they arrive damaged or defective.

Digital downloads are non-refundable once delivered.

Services or Subscriptions from our Site which are not refunded within the 3 day window. 

Processing Refunds

Method: Refunds will be processed using the original payment method.

Time Frame: Approved refunds will be processed within 10 business days. Please note that it may take additional time for your financial institution to process the refund. 

Changes to Refund Policy

We may update the Refund Policy from time to time without notification. It is your responsibility to remain up to date with changes to the Refund Policy.

Software

As part of our Site, we may include software to enhance your experience. This software may include order tracking, marketing, augmented reality /mixed reality and virtual galleries. We grant users of the Site a non-exclusive, revocable and non-transferable licence to use such software solely in connection with our Site or Services, and in accordance with these Terms. You may not reproduce, copy or redistribute any such software. We cannot be held liable for the operation, level of service, functionality or connectivity of 3rd party software accessed through this Site. 

Liability

Our liability is limited to the transaction amount unless otherwise determined by the judicial system of the United Kingdom of England and Wales. While we make efforts to verify the authenticity of artwork, we do not guarantee the authenticity of any artwork and cannot be held liable for any fraudulent, copyrighted, or illicit artwork sold through the platform. Our decision in handling disputes is final. We will not contribute to litigation costs between parties. We will contribute to providing evidence for civil litigation for a non-refundable legal fee. We will never share or sell your personal data, unless for internal business operations or to support valid Law Enforcement requests, which can be made in writing to info@newsite.art-hub.vip. 

We reserve the right to change, modify, or remove the contents of the Site or Services at any time or for any reason at our sole discretion without notice, with no obligation to update any information on our Site or Services. We also reserve the right to modify or discontinue all or part of the Site or Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Site or Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site or Services, resulting in interruptions, delays, or errors. You agree to waive us liability for any financial loss, damage, or inconvenience caused directly or indirectly by your inability to access or use the Site or Services during any downtime or discontinuance. 

Dispute Resolution

In the unlikely event of a dispute, we will act fairly and independently to mediate and attempt to resolve disputes between buyers, sellers, and 3rd parties including shipping agents, and you authorise us to act as an agent on your behalf where necessary. Where an agreed resolution cannot be made, we will make a final determination on behalf of all involved parties which may result in the transfer or reversal of funds. These decisions are final, unless otherwise ruled by the relevant Judicial Court. We are not a member of an Alternative Dispute Resolution (ADR) scheme or trade authority, but you can find additional resources through the European Commission for Consumers (EU), or CitizensAdvice (UK). 

Account Termination

We reserve the right to terminate user accounts for any prohibited activities or violations of these Terms. Any existing account funds on terminated accounts will be forfeited and recovered by the Site. Any forfeited funds will not be returned to the account owner, and the user will be barred from access to goods or services through the Site. Any purchases made by terminated or barred users will not be fulfilled but payment will be taken and no refunds will be provided.
